Document Description
The project consists of a Zoning Ordinance Amendment request to remove two conditions of approval from Exhibit ‘C’ of SZC-2007-0015 (ZMA #5545, 2006-0244) relating to the requirement for for-sale units and compliance with originally approved site plan and building elevation exhibits. Specifically, elimination of: Condition of Approval #1: “The landowner shall develop condominium units, town houses or detached single-family residences on the Subject Property. These shall be for-sale products.” Condition of Approval #3: “Any project in substantial compliance with Exhibit “D” and Exhibit “E” shall have final approval by the appropriate hearing body. Any project not in substantial compliance with Exhibits “D” or “E” shall have final approval by the Board of Supervisors upon a recommendation of the appropriate hearing body.”

Reasons for Exemption
Reasons Why Project is Exempt: The project is exempt from CEQA pursuant to California Code of Regulations, Title 14, § 15061(b); the activity is covered by the general rule exemption that CEQA applies only to projects which have the potential for causing a significant effect on the environment, and where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment. This PLNP2025-00008, Chandra Commons Apartments proposal does not propose any physical development. This request is a Zoning Ordinance Amendment request to the Board of Supervisors for elimination of two conditions of approval associated with the property’s Board-approved rezone per 2006-0244, County Initiated Rezone Program #4 (Site #28). As described below, these conditions are tangential aspects unrelated to potential physical impacts to the property or surrounding environment. In 2007 the Board of Supervisors approved two conditions of approval through the 2006-0244, County Initiated Rezone Program #4 (Site #28), one requiring for-sale residences, and, the other requiring a specific architecture and site plan; refer to project description above. The requirements of for-sale residences and a requiring a specific architecture and site plan were unrelated to any adopted regulatory policy at the time, being neither Sacramento Zoning Code (SZC) development standards nor Rio Linda / Elverta Community Plan requirements. The requirement for-sale products and the requirement to adhere to a specific architectural site plan and building architectural elevation was agreed to by the then-property owner in response to community opposition. Within the SZC, both for-sale and rental dwelling units are treated equally without any policy distinction, and there are neither any policies nor requirements specifying what product type (i.e., for-sale vs. rental) should exist in the Multiple Family Residential 20 (RD-20) zoning district. Furthermore, within the RD-20 zoning district, all types of primary household living uses (e.g., duplex, houses, townhomes, condominiums, apartments) are permitted by-right, though subject to Design Review per SZC § 6.3.2.A. Design Review - General. As such, the decision to require for-sale dwellings, or allow rental dwellings, has no bearing with the RD-20 zoning district development standards. In general, architectural styles are assessed per the Countywide Design Guidelines criteria and site layout criteria include standard emergency and standard vehicle circulation requirements. Overall, the removal of the two conditions of approval (#1 and #3, above) will have no bearing on the property nor any impacts to the physical environment. Thus, where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA.
