The project is exempt from the California Environmental Quality Act pursuant to Section 15301 (Existing Facilities) of the CEQA Guidelines (14 Cal. Code Regs., Section 15301). CEQA's Class 1 exemption applies to the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use (CEQA Guidelines §15301). The restaurant is a permitted use, and the Minor Modification does not involve an expansion of said use. Therefore, the proposed Minor Modification is exempt from CEQA.
