Document Description
Area Assignment AA-26-01 with Nielsen Beaumont Marine, Inc. for the temporary use of approximately 7,010 square feet of Port paved land adjacent to Berth D43 at Pier D for vessel dismantling and hauling. There will be no modifications to the premises, and all equipment and materials will be removed from the premises at the end of each work day. The proposed Area Assignment will be effective upon execution by the Chief Executive Director and shall expire no later than six (6) months from the effective date, unless terminated after the first 30 days upon 10 days’ written notice by either party.

Reasons for Exemption
The Class 1 Categorical Exemption consists of the operation, repair, maintenance, permitting, leasing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use. The project consists of Area Assignment AA-26-01 with Nielsen Beaumont Marine, Inc. for the temporary use of approximately 7,010 square feet of Port paved land at Pier D for vessel dismantling and hauling. Berth D43 is currently used by the Port of Long Beach for temporary berth assignments. Historically, the premises and surrounding area was used as a shipyard for cargo shipbuilding. Therefore, the project involves negligible expansion of existing or former use. The Port has determined that none of the exceptions to the exemptions in the California Environmental Quality Act (CEQA) Guidelines Section 15300.2 foreclose the use of the categorical exemption CEQA Guidelines Section 15301 (Class 1. Existing Facilities); therefore, the project is exempt from CEQA and no further environmental review is required.
