Document Description
Replacement of approximately 1,192 lineal feet of existing 8-inch diameter sewer main with 10-inch diameter sewer pipe, reconnection of existing sewer laterals, rehabilitation of four access holes, and restoration of existing street improvements including pavement striping, markings, and markers. The improvements are located within the Jefferson Street public right-of-way between Buena Vista Way and Laguna Drive. The project is to be constructed by the developer of Carlsbad Tract No. 2024-0004 (Jefferson Street Homes) pursuant to a Reimbursement Agreement for Costs for Construction of Public Sewer Improvements, subject to approval by the Carlsbad City Council, with reimbursement to be funded through CIP No. 5558.

Statutory Exemption: Public Resources Code Section 21080.21 (Underground Utility Pipeline Projects)
Reasons for Exemption
Public Resources Code Section 21080.21 exempts from CEQA any project to install a new pipeline or replace an existing underground pipeline if the project meets all of the following conditions: (1) the project consists of the installation of a new pipeline or the replacement or maintenance of an existing underground pipeline; (2) the project is less than one mile in length; (3) the project is located within an existing, improved public right-of-way; and (4) the project is not located in a special flood hazard area or a regulatory floodway.
The proposed project satisfies all four conditions. The project consists of the replacement of an existing underground sewer main. The total project length is approximately 1,192 lineal feet, which is less than one mile. The improvements are located entirely within the improved Jefferson Street public right-of-way. The project is not located within a special flood hazard area or regulatory floodway.
Accordingly, the project is statutorily exempt from CEQA pursuant to Public Resources Code Section 21080.21 and no further environmental review is required.
