Document Description
The California Department of Fish and Wildlife (CDFW) has executed Lake or Streambed Alteration Agreement number EPIMS-LAN-34126-R5 Amendment – A1, pursuant to Section 1602 of the Fish and Game Code to the Los Angeles County Flood Control District (LACFCD). LACFCD proposes to continue project activities related to the routine maintenance of its existing flood control facility at Eaton Wash Dam and Reservoir. The project is limited to routine mowing, debris removal, tree trimming, brush clearance, entrainment channel maintenance, limited sediment removal, and access road maintenance. The present Amendment expands the authorized annual mowing footprint to include areas burned during the 2025 Eaton Fire. In January 2025, the Eaton Fire burned a significant portion of the Eaton Wash watershed as well as all of the vegetation within Eaton Wash Reservoir. The vegetation and riparian habitat described in the original Agreement as executed in January 2023 no longer exists in a form that provides suitable habitat for least Bell’s vireo or other sensitive species. The amendment of this Agreement authorizes the expansion of annual vegetation maintenance into these burned areas. This Amendment also authorizes a one-time sediment removal event and clarifies conditions for the removal of non-native plants, trash, and debris.

Reasons for Exemption
On May 12, 2026, the Los Angeles County Flood Control District, the Lead Agency, determined that the Project is categorically exempt pursuant to California Code of Regulations, Title 14, section 15301. The Lead Agency determined that the Project meets certain qualifying criteria for the exemption. Pursuant to Public Resources Code section 21080.1(a), the Lead Agency is responsible for determining whether the Project is exempt from CEQA and that determination shall be final and conclusive on all persons, including Responsible Agencies. As a result, CDFW, acting as a Responsible Agency, is bound by the Lead Agency’s determination that the Project is exempt from CEQA.
