Reasons for Exemption
The Class 1 Categorical Exemption consists of the operation, repair, maintenance, permitting, leasing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use. The proposed action consists of the acquisition of an existing developed property, including one (1) existing office building of approximately 226,748 rentable square feet, involving negligible or no expansion of existing or former use.

Reasons for Exemption
The proposed action of acquiring an existing developed property is administrative and procedural in nature, and involves no physical activity, as no physical improvements, demolition, redevelopment, or changes to the existing facility are proposed. It can be seen with certainty that there is no possibility the action will have a significant effect on the environment. Therefore, the proposed action is exempt from CEQA pursuant to State CEQA Guidelines Section 15061(b)(3) and no further environmental review is required.
The Port has determined that none of the exceptions to the exemptions in the California Environmental Quality Act (CEQA) Guidelines Section 15300.2 foreclose the use of Categorical Exemption CEQA Guidelines Section 15301 (Class 1. Existing Facilities) and Section 15061 (b)(3) (Common Sense Exemption); therefore, the Project is exempt from CEQA and no further environmental review is required.
