Document Description
Pursuant to Resolution No. 2026-150, the County of Riverside ("County") intends to submit Riverside County Transportation Commission ("Commission") Ordinance No. 26-001 ("Ordinance") to their voters at the County's November 3, 2026 Statewide General Election. The underlying Ordinance authorizes the Commission to continue to levy a countywide sales tax within Riverside County. Beneficiaries of the Ordinance include residents of Riverside County and users of transportation infrastructure in Riverside County.

Reasons for Exemption
The activity is ministerial and therefore exempt from the California Environmental Quality Act (CEQA) pursuant to Public Resources Code §21080(b )(1 ). The County does not exercise discretion over the contents of the Ordinance, which was adopted by the Riverside County Transportation Commission (RCTC), a separate legal entity, nor is the County the lead agency for purposes of studying the Ordinance's environmental effects. Because the County lacks the authority to condition the Ordinance to mitigate environmental impacts, preparation of environmental review would serve no meaningful purpose. (Leach v. City of San Diego (1990) 220 Cal. App.3d. 389) The County is simply responsible for placing this Ordinance on its ballot. For these reasons, the activity is ministerial. Additionally, the common sense exemption (State CEQA Guidelines section 1506l(b)(3) applies because there is no possibility that the County's procedural action of submitting the Ordinance to voters will have a physical environmental impact.
