Reasons for Exemption
Resolution No. 05-26-1234 provides for the imposition of a standby charge for the purpose of financing the District's West Basin Water Recycling Program. The standby charge is exempt from review under the California Environmental Quality Act ("CEQA"). First, the standby charge, in and of themselves, does not have the potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment and therefore are not considered a “project” under CEQA. (Pub. Resources Code, § 21065, 14 Cal. Code Regs., § 15378, subd. (a).) Second, the standby charge is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment; here, there is no possibility that the standby charge, in and of themselves, may have a significant effect on the environment since they only produce the minimum revenue needed to cover projected operating costs. (14 Cal. Code Regs., § 15061, subd. (b)(3).) And third, even if the standby charge is considered a project for purposes of CEQA, the standby charge is still exempt because CEQA does not apply to the modification and approval of rates for the purpose of obtaining funds for capital projects, in this case the Water Recycling Program, necessary to maintain service within existing service areas. (14 Cal. Code Regs., § 15273, subd. (a)(4).) Here, the standby charge is needed to finance a portion of the debt service for the Water Recycling Program of the District. These charges are a continuation of the charge imposed during prior fiscal years and have not been increased.
