Reasons for Exemption
The City of San Diego conducted an environmental review that determined the project would not have the potential to cause a significant effect on the environment. The proposed easement vacation meets the criteria set forth in CEQA Guidelines Section 15305, which allows for minor alterations to land use limitations as long as the average slope on site is less than 20% and would not result in any changes in land use or density. The project site does not contain slopes greater than 20% on average across the site and the project would not change land use or increase density. Privatization and abandonment/removal of the existing public water main would meet the criteria set forth in CEQA Guidelines Section 15301, which includes operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use. The privatization of existing utilities involves no expansion of use. Therefore, this exemption was deemed appropriate.
The City reviewed the exceptions outlined in CEQA Guidelines section 15300.2 and determined that none apply. The project is not located in an environmentally sensitive area as defined by CEQA Guidelines section 15300.2(a). The project is expected to have no significant cumulative impact, as identified in CEQA Guidelines section 15300.2(b). No significant effect due to unusual circumstances would result from the project as identified in CEQA Guidelines section 15300.2(c). Considering the nature of the project and its location, no scenic highway impact would occur as identified in CEQA Guidelines section 15300.2(d). The site is not located on a list compiled pursuant to section 65962.5 of the Government Code for hazardous waste sites as identified in CEQA Guidelines section 15300.2(e). No historic resources exist on the site, and the project would not cause a substantial adverse change in the significance of a historical resource as identified in CEQA Guidelines section 15300.2(f), Therefore, none of the exceptions apply.
