Document Description
The proposed project consists of installing a metal chain link cross-levee fence (CLF) up and over the levee and recessed stairs with railing on the landside of the levee. The fence will have 6-foot-high by 8-foot-wide sections on both slopes. The waterside slope will be approximately 50 feet in length with 7 removable sections and the landside slope will be approximately 30 feet in length consisting of 5 sections that are not removable. There will also be a 14-foot-wide double-leaf gate across the levee crown for vehicle access, 33 concrete steps on the landside slope, each 36-inches wide, with an adjacent 6-inch-wide concrete curb, all flush with the levee slope, a metal handrail on the landside levee slope and a 36-inch by 42-inch concrete landing at the top and bottom of the stairs. The maximum excavation depth for the stairs on the slope will be 12 inches. The posts for the CLF will be embedded 18 inches below the crown and slope.

Reasons for Exemption
Board staff has determined that the project is exempt from CEQA under the Class 2, Replacement or Reconstruction categorical exemption (California Code of Regulations, Title 14, 15302), because the activity consists of replacement and reconstruction of an existing structure in the same site and will have substantially the same purpose and capacity as the replaced structure. Board staff has determined that the project is also exempt from CEQA under the Class 3, New Construction or Conversion of Small Structures categorical exemption (California Code of Regulations, Title 14, Section 15303), because the activity consists of construction and location of limited numbers of new, small facilities or structures; installation of small new equipment and facilities in small structures; and the conversion of existing small structures from one use to another where only minor modifications are made in the exterior of the structure. Board staff has determined that the project is exempt from CEQA under the Class 4, Minor Alterations to Land categorical exemption (California Code of Regulations, Title 14, Section 15304), because the activity consists of minor public or private alterations in the condition of land, water, and/or vegetation which do not involve removal of healthy, mature, scenic trees except for forestry or agricultural purposes. Further, none of the exceptions to the exemptions in California Code of Regulations, Title 14, Section 15300.2 apply.
