Reasons for Exemption
The project consists of the annual adoption of resolutions authorizing the Fiscal Year 2026-27 levies for nine existing CFDs. The action is exempt from CEQA pursuant to CEQA Guidelines Section 15273(b) (Rates, Tolls, Fares, and Charges), because the levies constitute charges used for the purpose of meeting operating expenses, funding ongoing maintenance of existing public facilities, meeting financial reserve requirements, and supporting capital needs necessary to maintain service within existing CFD service areas. The levies will not be used to fund capital projects that would expand any system within the CDFs.
The action is also exempt under CEQA Guidelines Sections 15060(c)(3) and 15378(b)(4) and (5) because the adoption of annual levy resolutions is a government fiscal and administrative activity that does not result in a direct or reasonably foreseeable indirect physical change in the environment and therefore does not constitute a CEQA project.
