Reasons for Exemption
The project consists of a Vesting Tentative Parcel Map to subdivide an existing 10.7-acre parcel into two parcels of approximately 5.18 and 5.52 acres each for the purpose of sale and/or future development. The site is currently developed with a single-family residence, two wells, and an individual on-site wastewater system. Each proposed parcel would be served by individual well and septic. Proposed Parcel 1 would retain the existing residence and access from Old Oak Park Road, and proposed Parcel 2 would take access from Ormonde Road. No new residential development is proposed as part of this land use entitlement. The proposed project is within the Residential Rural land use category and is located at 1720 Old Oak Park Road, approximately one mile north of the City of Arroyo Grande city limits, in the San Luis Bay Inland Sub-area South of the South County Planning Area. As part of the project design, the applicant incorporated a future building envelope on proposed Parcel 2 to direct future development to an area that avoids mapped oak woodland, riparian scrub, wetland/vernal marsh habitat, and other sensitive habitat areas identified on the project site. The focused rare plant survey prepared by Kevin Merk Associates, LLC, dated January 17, 2025, found that no rare or special-status plants were observed onsite. The report identifies annual grassland, coastal scrub, eucalyptus, oak woodland, riparian scrub, ruderal, and wetland/vernal marsh habitat on the property, and identifies wetland/vernal marsh and riparian scrub habitats as sensitive natural communities. The applicant-proposed building envelope was designed to avoid impacts to oak trees, species that may occur in association with oak woodland habitat, and mapped sensitive habitat areas at the time of future development. The project has also been conditioned to require the additional map sheet to include a visual representation of the approved building envelope for proposed Parcel 2. Prior to issuance of construction or grading permits for future development on proposed Parcel 2, the proposed site disturbance area must be reviewed for consistency with the approved building envelope, and site disturbance must avoid mapped oak woodland, riparian scrub, wetland/vernal marsh habitat, and other sensitive habitat areas unless additional biological review and any required County, State, or federal approvals are obtained. The conditions also require an oak tree inventory and protection plan prior to future construction or grading permits for any future development or access improvements that may impact native oak trees. A Phase I Cultural Resource Inventory dated February 2025, prepared by Albion Environmental, Inc., was prepared for the project. The report included background research, records search, and pedestrian survey, and concluded that no cultural resources were identified within the project area and no further archaeological investigation is warranted under CEQA. The project has also been conditioned to require work to stop in the immediate vicinity of any archaeological resource encountered during ground-disturbing activities until a qualified archaeologist evaluates the resource and recommends appropriate treatment measures, as necessary. If human remains are discovered, work must stop immediately and the County Coroner must be contacted in accordance with State law. Based on the limited scope of the land division, the absence of new residential development as part of this entitlement, the biological and cultural resource investigations prepared for the site, and the incorporation of an approved building envelope and map-sheet restrictions to avoid mapped biological resources and sensitive habitat areas, it can be seen with certainty that the project would not result in a significant effect on the environment. Therefore, the project is exempt from CEQA pursuant to CEQA Guidelines section 15061(b)(3), General Rule Exemption.
