Reasons for Exemption
The SBVC Student Housing Project would qualify as statutorily exempt from CEQA pursuant to Section 21080.66 of the California PRC because the Project is a mixed-use residential development surrounded by urban uses. The Project is not located within a sensitive area and meets applicable minimum density requirements. The Project type would not result in a land use conflict due to being exempt from local zoning regulations as specified by CA Education Code Section 81055 (AB 648) and satisfies the requirements for CEQA statutory exemption under PRC 21080.66 (AB 130). The Proposed Project’s eligibility for Statutory Exemption under AB 130 is possible in conjunction with the provisions of AB 648. The Project would not be eligible under AB 130 alone, as the Project would not be consistent with the existing General Plan land use and zoning designations. However, Section 81055 of the Education Code permits development of student housing on property owned or leased by a community college district or state property to address California’s growing affordable housing shortage. The Project Site is located entirely on parcels that would be owned by the District for the construction of an affordable student housing development and would meet the exemption requirements as codified in Public Resources Code (PRC) Section 21080.66.
