Reasons for Exemption
The grading work proposed on the borrow site is exempt from CEQA pursuant to California Code of Regulations, Title 14, Section 15304 – Class 4, which applies to minor public or private alternations in the condition of land, water, and/or vegetation which do not involve the removal of mature, scenic trees except for forestry and agricultural purposes.
The proposed grading work proposes borrowing approximately 44,000 cubic yards of raw native fill material from the subject property (“borrow site”) with an average cut of 3.6 feet below existing grade. The applicant will then export the native fill material to an adjacent offsite location. None of the exceptions enumerated in State CEQA Guidelines section 15300.2 apply to the exemptions applicable here.
The existing grades of the borrow site contain slopes of less than 10 percent. The proposed borrow site grading work also avoids any jurisdictional waterways, wetlands and/or riparian areas. Jurisdictional features (Santa Gertrudis Creek) will be avoided with a 10-foot buffer and standard BMPs will be implemented prior to construction. BMP’s will be monitored and managed during construction as-needed. No permanent structures will be constructed; the grading activity is temporary and limited to soil movement. Lastly, the subject borrow site isn’t an officially designated scenic area nor located in geologic hazard zones. The aforesaid findings are supported in the prepared borrow plan, environmental reports, and geotechnical reports for the subject borrow site.
