The Class 1 Categorical Exemption consists of the operation, repair, maintenance, permitting, leasing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use. The Port will issue a Level I HDP for minor alteration of existing facilities to install seven (7) embedded piles, approximately 50-feet long and 18 inches in diameter, and a new 40-foot by 82-foot floating platform with three mooring slots to retrofit an existing damaged dock involving negligible or no expansion of existing or former use.

Reasons for Exemption
The Class 2 Categorical Exemption consists of replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced. The replacement of the existing embedded piles with seven (7) new embedded piles, approximately 50-feet long and 18 inches in diameter will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced. All equipment that is removed from the site will be disposed of in a manner that meets all federal, state and local environmental and regulatory requirements.
