Reasons for Exemption
The Class 1 Categorical Exemption consists of the operation, repair, maintenance, permitting, leasing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use. The Port will issue a Level I HDP for minor alteration of existing facilities consisting of minor improvements for the installation of a new fixed-portal x-ray cargo inspection system that will replace an existing Vehicle and Cargo Inspection System (VACIS) and is not expected to contribute to an expansion of existing use, capacity, or throughput and involves negligible or no expansion of existing or former use.

Reasons for Exemption
The Class 2 Categorical Exemption consists of replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced. The new replacement of the existing Vehicle and Cargo Inspection System (VACIS) with a new fixed-portal x-ray cargo inspection system and new pedestals to screen cargo in containers will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced. All equipment that is removed from the site will be disposed of in a manner that meets all federal, state and local environmental and regulatory requirements.
