Reasons for Exemption
The California Environmental Quality Act (Section 21000, et. seq. of the California Public Resources Code, hereafter CEQA) requires analysis of agency approvals of discretionary “projects.” A “project,” under CEQA, is defined as “the whole of an action, which has a potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment.” (CEQA Guidelines § 15378(a)). The CEQA Guidelines, Section 15305 Minor Alterations in Land Use Limitations Class 5(a) specifies that Lot line adjustments in areas with an average slope less than 20% which do not result in any changes in land use or density are exempt from further environmental review under CEQA. The project consists of a Lot Line Adjustment to adjust the property lines. Staff reviewed the proposed project and did not find any evidence that special circumstances exist that would create a reasonable possibility that the proposed project will have a significant adverse effect on the environment. Therefore, the proposed project qualifies for the exemption under CEQA Guidelines Section 15305(a) and no further environmental review is required
