Reasons for Exemption
CEQA requires analysis of agency approvals of discretionary “projects.” A “project,” under CEQA, is defined as “the whole of an action, which has a potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment” (State CEQA Guidelines Section 15378). The proposed Project is a project under CEQA. The Project is exempt from CEQA pursuant to State CEQA Guidelines Section 15315 (Minor Land Divisions). This exemption provides for the division of property in urbanized areas zoned for residential, commercial, or industrial use into four or fewer parcels when the division is in conformance with the General Plan and zoning, no variances or exceptions are required, all services and access to the proposed parcels to local standards are available, the parcel was not involved in a division of a larger parcel within the previous two years, and the parcel does not have an average slope greater than 20 percent. The site was part of a larger parcel map subdivision in 1978 and the average slope across the site is approximately 1.6 percent. The exceptions to the use of a categorical exemption under State CEQA guidelines Section 15300.2 are inapplicable: 1. The Project is consistent with the land use designation, zoning, and intensities established in the General Plan and would not contribute to significant cumulative impacts beyond what is anticipated under the General Plan and its EIR (State Clearinghouse No. 2017062058). 2. The Project site was previously disturbed, developed and is surrounded by rural residential development. The Project complies with all City Standards: a. EGMC 16.44 Land Grading and Erosion Control b. EGMC 16.50 Flood Damage Prevention c. EGMC 19.12 Tree Preservation and Protection d. Climate Action Plan Consistency Checklist 3. The site does not contain scenic highways or other scenic resources. 4. The site does not contain any hazardous materials and is not any active hazard material site lists pursuant to Government Code Section 65962.5. A search of the State Water Resources Control Board and California Department of Toxic Substance Control databases was conducted on June 23, 2025. 5. There are no known historic resources on the Project site and the site is disturbed. However, in the future when development is proposed, the future development will need to comply with the General Plan Mitigation Measures 5.5.1a to confirm no resources exist. The Applicant provided a Cultural Resources Investigation dated January 2026. The document was prepared by Natural Investigation Company, Inc. It was noted that the document meets the requirements for compliance regarding the identification of unique archaeological resources and historical resources. No other special circumstances exist that would create a reasonable possibility that the proposed Project will have a significant adverse effect on the environment. Therefore, the Project qualifies for the exemption under State CEQA Guidelines Section 15315 and no further environmental review is required
