Document Description
The project would include site improvements at an existing City park. The Site includes the former indoor rifle and pistol shooting range located at 2140 34th Avenue in Sacramento, California within James Mangan Park. The approximately 10-acre park also contains picnic areas, children 's play equipment, a swimming pool, an outdoor archery range, and soccer fields. The Sacramento Executive Airport (SEA) is located immediately south of the Site, and the Mangan Park residential neighborhood is located to the north. The proposed park improvements would disturb approximately 0.23 acres of land and include minor grading to allow for construction of concrete walkways and the installation of 3 ADA-accessible concrete ramps, as well as minor irrigation line adjustments and landscaping to the new walkway and concrete ramps.

Reasons for Exemption
The proposed project includes minor grading to facilitate the construction of improvements an existing City Park, including construction of concrete walkways and installation of 3 ADA-accessible ramps, as well adjustments to existing irrigation lines and landscaping. The improvements proposed at Mangan Park are project types that would typically qualify as exempt from further environmental review pursuant to CEQA Guidelines Sections 15301. Existing Facilities, 15303. New Construction or Conversion of Small Structures, and 15311. Accessory Structures. In this case, the Mangan Park Improvements cannot qualify as exempt due to the 2130 34th Avenue address being listed as cleanup program site by the California Department of Toxic Substances Control (DTSC) for the sites past use a rifle and pistol range and the potential for lead contamination. CEQA Guidelines Section 15300.2(e). Exceptions, states that a categorical exemption shall not be used for a project located on a hazardous site which is included on any list compiled pursuant to Section 65962.5 of the Government Code. The City of Sacramento, in conjunction with subject matter expert consultant staff, developed and implemented a Local Remediation Program for the park, Site No. 223; RO0001707 James Mangan Park Rifle and Pistol Range Lead Clearance, Building Abatement. Sacramento County Environmental Management Department reviewed the Stantec Consulting Services, Inc, August 20, 2019, Monitoring and Maintenance Plan, Former James Mangan Park. Rifle & Pistol Range. Based on review of the documentation submitted to date, it is SCEMD's position as of September 5, 2019, that the subject property has met clearance standards in accordance with Title 17 of the California Code of Regulations. Division 1, Chapter 8. and that no further cleanup is required at this time. Despite site meeting the SCEMD and DTSC clearance standards for hazardous material cleanup, it cannot be removed from any list of hazardous sites and unable to utilize any streamlining opportunities from the categorical exemptions listed in the CEQA guidelines. The project is therefore consistent with CEQA Guidelines Section 15061 (b)(3) , the commonsense exemption, which states that a project is exempt from CEQA if, the activity is covered by the common sense exemption that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA The project consists of site improvements to an existing City Park, which has undergone extensive cleanup efforts, received approval from Sacramento County Environmental Management Department and State Department of Toxic Substances Control that the subject property has met clearance standards in accordance with Title 17 of the California Code of Regulations, Division 1, Chapter 8, and that no further cleanup is required at this time The proposed improvements at the existing Mangan Park Facility are de minimis, and would have otherwise qualified as exempt, if not for its continued listing compiled pursuant to Section 65962.5 of the Government Code, despite receiving approval that no further cleanup is required.
