Reasons for Exemption
The Board has determined that affirming the Cease-and-Desist Order for Enforcement Case No. 2024-15436 is exempt from CEQA under the Class 21, Enforcement Actions by Regulatory Agencies categorical exemption (California Code of Regulations, Title 14, Section 15321). Affirming the Cease-and-Desist Order constitutes an administrative enforcement action requiring compliance with law, general rule, standard, or objective administered or adopted by the Board to address unauthorized encroachments within the State Plan of Flood Control. Affirming the Cease-and-Desist Order is corrective in nature, intended to address and remedy an existing violation and requires the submittal of a Compliance Plan and Schedule for future review and approval, but does not result in a direct or indirect physical change in the environment. The Board retains full discretion to consider environmental impacts and conduct any required CEQA review upon consideration of the Compliance Plan and Schedule, once submitted. Further, Board staff has determined that none of the exceptions to the categorical exemptions set forth in California Code of Regulations, Title 14, Section 15300.2 apply, as affirming the Cease-and-Desist Order itself would not result in a significant effect on the environment.
