Document Description
In its Resolution No. 2026-1, the Kern-Tulare Water District’s (“District”) Board of Directors approved the “Invasive Mussel Control – Chemical Feed Installation Plan” (“Invasive Mussel Control Project”). The District complied with the California Environmental Quality Act (“CEQA”) (Pub. Resources Code, § 21000 et seq.) for its approval of the Invasive Mussel Control Project by determining that the Invasive Mussel Control Project was exempt pursuant to CEQA and the State CEQA Guidelines (Cal. Code Regs., tit. 14, § 15000 et seq.), specifically, Public Resources Code Section 21080(b)(4) (Emergency Projects) and CEQA Guidelines Sections 15061(b)(3) (Common Sense Exemption), 15269(b)&(c) (Emergency Projects), 15301 (Class 1 Existing Facilities), 15304 (Class 4 Minor Alterations to Land) and 15308 (Class 8 Actions by Regulatory Agencies for Protection of the Environment). The Project is the approval of a “Golden Mussel Control Plan,” prepared pursuant to statutory and regulatory requirements, including California Fish and Game Code Section 2301(d) and regulatory directives of the California Department of Fish and Wildlife (“CDFW”), and submittal of that “Golden Mussel Control Plan” to CDFW.
