Document Description
NOTICE OF EXEMPTION for the DR24-0004. The project request comprises of a single-story 6,669 square foot warehouse space addition and a two-story 8,102 square foot administrative addition. The project is an increase of use of the existing warehouse and administrative functions approved in 1995. The existing structure includes 8,190 square feet of warehouse and 7,200 square feet of administrative office use. Both warehouse storage and administrative uses are allowed pursuant to the South Poway Specific Plan. Bay City Equipment Industries Inc. shall use the warehouse space to store mechanical rental equipment such as portable electric generators and similar devices. The project site will also serve as an administrative office for the day-to-day functions of the business.

Reasons for Exemption
The project meets all standards pursuant to Guidelines Section 15332(a) through 15332(e) listed below: (a) The project is consistent with the applicable general plan designation and all applicable general plan policies as well as with applicable zoning designation and regulations: The warehouse expansion project is consistent with the development standards of the South Poway Specific Plan (SPSP). Building height, site layout, and density meet the requirements of the SPSP. No variances or amendments that would require additional environmental analysis are proposed. (b) The project occurs within city limits on a project site of no more than five acres substantially surrounded by urban uses: The project site is entirely located within the City limits of the City of Poway. The entire development site envelope shall impact less than five acres and is substantially surrounded by urban uses. The 3.21-acre parcel is fully developed and located within an established urbanized area characterized by existing roadway infrastructure and nearby commercial and industrial uses. California Public Resources Code § 21080.66 (AB130) went into effect June 30, 2025, as a Statutory exemption that effectively increases the five-acres to 20-acres utilized by the Class 32 exemption. (c) The project has no value as habitat for endangered, rare or threatened species: The existing development consists of an industrial warehouse building and paved surfaces. Due to long-term disturbance and lack of native vegetation or habitat features, the site does not support sensitive biological resources. (d) Approval of the project would not result in any significant effects relating to traffic, noise, air quality, or water quality: The project would not result in any significant environmental effect related to traffic, noise, air quality, or water quality. The scale and intensity of the project site is consistent with surrounding development would not result in significant traffic generation or other environmental impacts. Construction actives will be subject to compliance with the City of Poway Municipal Code requirements, Poway’s Noise Ordinance standards, and Best Management Practices (BMPs) for dust control and stormwater management. (e) The site can be adequately served by all required utilities and public services: The project area is currently serviced adequately by existing water, sewer, storm drainage, fire protection, and other municipal services with sufficient capacity to support the existing and proposed expansion development. All required utilities and public services can and shall be served at the project site. Furthermore, none of the exceptions to the use of categorical exemption, pursuant to Section 15300.2 of the CEQA Guidelines, are applicable to this project. The project site is not located on a hazardous material site, the cumulative impacts have been analyzed under the SPSP, and it does not present unusual circumstances that would result in significant environmental effects. Therefore, the project is Categorically Exempt from CEQA pursuant to CEQA Guidelines Section 15332.
