Reasons for Exemption
The Project will not result in a direct or reasonably foreseeable indirect physical change in the environment, as its contents are limited to identifying evacuation routes, analyzing their capacity, safety, and viability, and providing recommendations, as described above. The recommendations and activities in the Evacuation Analysis are limited to specific signal timing plans, counterflow operations, and alternate evacuation routes, none of which involve physical improvements. Therefore, the Project is exempt from the application of CEQA pursuant to the following regulations: 1. State CEQA Guidelines §15262: Feasibility and Planning Studies because the Evacuation Analysis involves only a feasibility study which may lead to possible future actions, which the City has not approved, adopted, or funded. 2. State CEQA Guidelines §15269: Emergency Projects because the Evacuation Analysis’ recommendations involve specific actions necessary to prevent or mitigate an emergency. 3. State CEQA Guidelines §15301: Existing Facilities [Class 1], because the Evacuation Analysis’ recommendations involve the operation of existing public facilities involving no expansion of existing or former use. 4. State CEQA Guidelines §15061(b)(3): The Safety Element textual updates will not result in a direct or reasonably foreseeable indirect physical change in the environment, as the amendment is limited to textual changes that do not involve any physical improvements. Therefore, it can be seen with certainty that there is no possibility that the Amendment to the General Plan Safety Element would have a significant effect on the environment. For these reasons, these activities are exempt from the application of CEQA under the common sense exemption (State CEQA Guidelines §15061(b)(3)). For the reasons noted above, the Project is exempt from CEQA.
