Notice of Exemption
Exempt Status
Categorical Exemption
Type, Section or Code
Section 15303 Class 3 New Construction or Conversion of Small Structures)
Reasons for Exemption
Pursuant to the California Code of Regulations, Title 14, Division 6, Chapter 3, 15303 Class 3 New Construction or Conversion of Small Structures is applied to the proposed project. This exemption allows for construction of new structures (including duplexes, stores, motels, etc.) up to 2,500 or 10,000 sf, and accessory structures (including but not limited to garages, carports, patios, swimming pools, and fences).
The project proposes to construct a new 5 ft x 105 ft pier, 3 ft x 24 ft gangway, 17 ft x 30 ft uncovered boatlift with 3 ft companion deck, as an accessory to the existing single family home.
Lakebed disturbance would be limited to the area where six (6) 10-inch diameter pilings and thirteen (13) 8-inch pilings will be installed using a free fall hammer method. No digging, constant vibration or drilling will be used. No holes will be augured or dug all pilings will be installed using a hammer to drive them directly into the lakebed.
The Habitat Evaluation that was prepared by the County’s Water Resources Department, notes that there are no tules on-site. At base of seawall, lakebed depth is approx. 6.1 ft Rumsey and at lakeward extent of proposed structure, lakebed depth is approx. -7.7 ft Rumsey. The lakebed has a moderate lakeward slope. According to the CA Dept. of Fish and Wildlife’s (CDFW) California Natural Diversity Database, habitat exists in the area for Konocti manzanita (Arctostaphylos manzanita ssp.). However, all work would be conducted from the water, the portion of the property where the dock would connect to currently contains gravel (no manzanita trees-refer to Habitat Evaluation Photos). As such, manzanita habitat would not be impacted. Additionally, the applicant will obtain a Lake and Streambed Alteration Agreement from CDFW and all lakebed disturbance would take place between October 15 and December 31 to protect the Clearlake hitch, unless otherwise approved by CDFW.
In accordance with California Code of Regulations, Title 14, Division 6, Section 15300.2, there would be no cumulative impacts related to the project; there are no known unusual circumstances that would have a significant effect on the environment; the project would not be located within an officially designated state highway; no trees, rock outcroppings or historic buildings would be removed or damaged; and there are no hazardous waste sites within 1,000 feet of the project site. Lastly, the County is unaware of any significant tribal cultural resources on-site, and included the local Native American Tribes during the review of this project; no adverse comments or information pertaining to known resources were received. Based on the aforementioned, the Lake County Community Development Department has determined that the project will not have a significant effect on the environment and is, therefore, exempt from the provisions of CEQA.
