Reasons for Exemption
Section 15301 of the California Environmental Quality Act (CEQA) Guidelines exempts from CEQA review, actions consisting of the “operation, repair, maintenance, permitting, leasing, licensing or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features involving negligible or no expansion of existing or former use.” The key consideration is whether the activity involves negligible or no expansion of an existing use. The project consists of maintenance and repair activities to a closed landfill managed by the Department of Public Works. The existing land use consists of a publicly-owned airport with related ancillary uses, which is underlain by the closed landfill. The project will result in negligible or no expansion of existing uses and therefore is categorically exempt from CEQA pursuant to Section 15301 of the State CEQA Guidelines.
