Reasons for Exemption
Board approval of the energy purchase agreements is not a "project" as defined by CEQA as it would not result in a direct or reasonably forseeable indirect change in the physical environment and further, does not have the potential to cause a significant effect on the environment. Project developer is responsible for obtaining all permits, including necessary environmental review and permits for the construction and operation of the project in the State of Utah, where the project will be located.
