Special Use Permit No. PSP 14-052 (PC) was approved by the Tulare County Planning Commission on October 26, 2016, as resolution no. 9235 and recorded on March 8, 2017, as Document No. 2017-0013150, which established a Solid Waste Recycling Operation (inert debris recycling facility) on a 11.4-acre portion of a 29-acre parcel in the M-1-MU (Light Manufacturing with Mixed-Use Overlay) Zone. The requested minor modification to Special Use Permit No. PSP 14-052 (PC) is to update the site plan to include a Compressed Natural Gas (CNG) fueling station. A CNG fueling station is allowed by-right use within the M-1-MU Zone. The beneficiaries of the Project would be the applicant.

Reasons for Exemption
Project is Exempt, consistent with the California Environmental Quality Act of 1970 (CEQA) and the State CEQA Guidelines, pursuant to Title 14, Cal. Code Regulations Section 15061(b)(3) the Common Sense Exemption. A previous Negative Declaration (SCH# 2016071073) was certified and adopted by the Tulare County Planning Commission on October 26, 2016, as resolution no. 9234 and recorded on March 8, 2017, as Document No. 2017-0013149. The proposed addition of the CNG fueling station will be on a portion of the reminder portion of Special Use Permit No. 14-052. The proposed activities would not raise any of the previously analyzed environmental factors, and all environmental factors would remain at a level of less than significant or no impact. The lead agency concludes that the proposed Project fits under the exemption as it is consistent with the Tulare County Zoning Ordinance and General Plan. Therefore, the Common Sense Exemption, CEQA guidelines 15061(b)(3) is applicable and appropriate for the proposed project.
