Document Description
SummerHill Homes, LLC ("SummerHill") is the developer of a residential community located to the northeast of Los Gatos High School. SummerHill desires to construct emergency vehicle access ("EVA") partially through the School District's property. The District and SummerHill are entering into an Agreement for SummerHill to design and construct the portion of the EVA on District Property and for the District and SummerHill to provide reciprocal emergency access to the District EVA and SummerHill EVA via non-exclusive easements. The District and SummerHill previously entered into an agreement to negotiate and enter into agreements to construct the EVA and grant reciprocal emergency access easements such as those now being approved.

The Project is ministerial because the District previously entered into an agreement obligating the District to enter into agreements for a right of entry agreement for SummerHill to construct the EVA and reciprocal emergency access easements such as those now being approved. Additionally, the District as Responsible Agency concurs with the Town of Los Gatos's finding as Lead Agency that additional environmental review is not necessary for the residential project pursuant to CEQA Guidelines Section 15183 because the project impacts were adequately addressed in the Environmental Impact Reports prepared for the 2020 General Plan (SCH 2009032078) and/or 2040 General Plan (SCH 2020070175), as applicable, and through implementation of applicable General Plan policies identified in the Initial Study for inclusion in the conditions of approval.
