Reasons for Exemption
The recommended vacation action is categorically exempt from further environmental review under the California Environmental Quality Act (CEQA), (Public Resources Code, Section 21000 et seq.), pursuant to State CEQA Guidelines Section 15301 (Class 1 – Existing Facilities) and Section 15305 (Class 5 – Minor Alterations in Land Use Limitations). Class 1 applies to “minor alterations of existing public or private structures, facilities or topographical features involving negligible or no expansion of existing or former use.” Class 5 applies to “minor alterations in land use limitations in areas with an average slope of less than 20 percent, which do not result in changes in land use or density.” The action involves the vacation of portions of Rosenbaum Road and Trabuco Creek Road that has been deemed excess and no longer necessary for public use. No construction, grading, or expansion of use is proposed or would occur as a result. The area proposed for vacation is located within an urbanized area, is generally flat, and has an average slope of less than 20 percent. Existing land use designations and zoning would remain unchanged. None of the exceptions to the use of a categorical exemption identified in CEQA Guidelines Section 15300.2 apply. The project is not located in a particularly sensitive environment, does not involve unusual circumstances, will not result in cumulative impacts, is not located along a designated state scenic highway, is not included on any list of hazardous waste sites compiled pursuant to Government Code Section 65962.5, and does not involve any historical resources.

Reasons for Exemption
In addition, the project is exempt from CEQA under the “common sense” exemption set forth in CEQA Guidelines Section 15061(b)(3), as it can be seen with certainty that there is no possibility the vacation of this excess easement may have a significant effect on the environment. The action involves only the vacation of portions of Rosenbaum Road and Trabuco Creek Road, no physical alterations would occur, and the action does not authorize any new development.
