The project site Is also located within the following planning and overlay areas: the Community Plan Implementation Overlay Zone (Type A), the Transit Area Overlay Zone, a Parking Standards Transit Priority Area, and a Transit Priority Area. LEGAL DESCRIPTION: That portion of Harvey Milk Street (formerly Blaine Avenue), according to amended map of University Heights made by G.A. D'Hemecourt in Book 8, Page 36, Et Seq. of Lis Pendens, Filed In the Office of the County Recorder of San Diego, August 2, 1888, being described as follows: An 11.00 foot wide strip lying parallel with the southwesterly line of lot 25 in Block 191 of said amended map of University Heights, (APN 445-641- 4000).

Reasons for Exemption
The City of San Diego determined that the project would qualify to be categorically exempt from CEQA pursuant to Section 15305, Minor Alterations in Land Use Limitations. The project meets the criteria set forth In CEQA Section 15305 which applies to minor alterations in land use limitations in areas with an average slope of less than 20 percent, which do not result in any changes in land use or density. The proposed vacated right-of-way (portion of Harvey Milk Street) Is along the frontage (140 feet in length by 11 feet in width) of an existing property that Is relatively flat in topography (311 feet Mean Sea Level (MSL) to 309 feet MSL), and no changes in land use or density would be proposed. The parkway area to be vacated to the curb would be maintained by the private property owner. The exceptions listed ln CEQA Section 15300.2 would not apply in that no cumulative impacts were Identified, no significant effect on the. environment was Identified; and the project is not adjacent to a scenic highway. The site Is not Included on any list complied pursuant to Government Code Section 65962.5 for hazardous waste sites. R-316734
