Reasons for Exemption
This Ordinance is exempt pursuant to State CEQA Guidelines Section 15061(b)(3) ("Common Sense") because it can be seen with certainty that the Ordinance will not have a significant effect on the environment. The Ordinance will make several clarifications to the Zoning Code in regard to equipment to reflect current Planning policies. Additionally, the removal of an allowable use from a residential zoning district has no possibility of having a physical impact on the environment. Further, as a Municipal Code text amendment, there is no possibility that the proposed action may result in a significant effect on the environment, and the proposed revision to the Municipal Code is exempt from further review under CEQA. Individual proposed projects that include wall or ground mounted equipment would be subject to individual CEQA review when necessary.
