Document Description
The California Department of Fish and Wildlife (CDFW) has executed
Streambed Alteration Agreement EPIMS Notification No. LAK-41405-R2, pursuant to Section
1602 of the Fish and Game Code to the project Applicant, City of Lakeport, as represented by
Ron Ladd.
The project is limited to headwall repairs caused by storm-related damages to the Main Street
culvert crossing of Forbes Creek in the City of Lakeport. The project will consist of replacing
the existing collapsed concrete headwall, installing bank erosion control on the south side of
the unprotected soil bank, restoring the eroded bank material, and replacing the sidewalk
above. Rip rap on the south side of the soil bank will be removed and replaced in kind. A net 0
cubic yards (CY) of fill will be placed within Forbes Creek to construct the new headwall wall,
with 73 CY of excavated material and 73 CY filled.
No in-water work will be required for the installation of the above mentioned activities,
construction activity will occur while the existing drainage is dry.
A variety of earthmoving equipment such as an excavator, loader and dump truck will do most
of the work within the site. Other typical construction vehicles and equipment will be present.

Reasons for Exemption
Lead Agency determined that the Project meets
certain qualifying criteria for the exemption. Pursuant to Public Resources Code section
21080.1(a), the Lead Agency is responsible for determining whether the Project is exempt
from CEQA and that determination shall be final and conclusive on all persons, including
Responsible Agencies. As a result, CDFW, acting as a Responsible Agency, is bound by the
Lead Agency’s determination that the Project is exempt from CEQA.
