Reasons for Exemption
The California Environmental Quality Act (CEQA) requires analysis of agency approvals of discretionary “Projects.” A “Project,” under CEQA, is defined as “the whole of an action, which has a potential for resulting in either a direct physical change In the environment, or a reasonably foreseeable indirect physical change in the environment” (CEQA Guidelines Section 15378). The proposed Project is a project under CEQA. Staff has determined that the Project is exempt from CEQA pursuant to State CEQA Guidelines Sections 15301 (Existing Facilities). Section 15301 applies to projects that consist of the operation repair, maintenance, permitting, leasing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use. This includes additions to existing structures provided that the addition will not result in an increase of more than 50 percent of the floor area of the structures before the addition, or 2,500 square feet, whichever is less. The Project involves the installation of a 3,500 square foot seasonal tent over an existing outdoor patio area provide shelter for diners in the existing outdoor seating area during the rainy and winter months. Since the existing outdoor seating area was previously approved through an Outdoor Activity Design Review, the installation of the seasonal tent will not result in an increase in floor area. Additionally, Staff has determined that the Project is exempt from CEQA pursuant to State CEQA Guidelines Section 15311 (Accessory Structures). Section 15311 applies to projects that consist of the construction, or placement of minor structures accessory to (appurtenant to) existing commercial, industrial, or institutional facilities. This includes the placement of seasonal or temporary use items such as lifeguard towers, mobile food units, portable restrooms, or similar items in generally the same locations from time to time in publicly owned parks, stadiums, or other facilities designed for public use. The Project involves the installation of a 3,500 square foot seasonal tent over an existing outdoor patio area provide shelter for diners in the existing outdoor seating area during the rainy and winter season between November 1 and April 30. The tent will be installed in the same location each season. All public services and facilities are available, and the area is not considered environmentally sensitive. Staff reviewed the proposed Project and did not find any evidence that special circumstances exist that would create a reasonable possibility that the proposed Project will have a significant adverse effect on the environment. Therefore, the proposed Project qualifies for the exemption under State CEQA Guidelines Sections 15301 and 15311 and no further environmental review is required.
