Document Description
The California Department of Fish and Wildlife has executed Lake and Streambed Alteration Agreement EPIMS Notification No. EPIMS-RIV-59451-R6 pursuant to Section 1602 of the Fish and Game Code to the City of Corona (Permittee) or as represented by Eugene Silvas. The Project is limited to maintenance consisting of trash and debris removal, removal of sand, sediment, vegetation, and non-native plant species within existing City facilities in South Norco Channel, North Norco Channel, Butterfield Channel, Clearwater Channel, and Temescal Creek, so that each facility will function and/or operate to its designed capacity. Maintenance activities include clearing all vegetation, debris, and sediment from within, or around, one bridge, two levees, 11 culverts, seven paved and unpaved roads, four roadside ditches, two storm drains, two airport emergency exits, two flood walls, and six unlined channels. Equipment used to complete maintenance activities includes chainsaws, weed whippers, rubber wheeled backhoes, dump trucks, excavators, dozers, backhoes, as well as hand and power tools.

Reasons for Exemption
On June 21, 2010, the City of Corona, the Lead Agency, determined that the Project is categorically exempt pursuant to Type – Class (1); California Code of Regulations, title 14, section (15301). The Lead Agency determined that the Project meets certain qualifying criteria for the exemption. Pursuant to Public Resources Code section 21080.1(a), the Lead Agency is responsible for determining whether the Project is exempt from CEQA and that determination shall be final and conclusive on all persons, including Responsible Agencies. As a result, CDFW, acting as a Responsible Agency, is bound by the Lead Agency’s determination that the Project is exempt from CEQA.
