Document Description
The California Department of Fish and Wildlife (CDFW) has amended and issued Lake and Streambed Alteration Agreement EPIMS Notification No. EPIMS-SBR-43408-R6, pursuant to Section 1602 of the Fish and Game Code to San Bernardino County Department of Public Works.
The Project is limited to the construction of Phase II for the Glen Helen Parkway Grade Separation Project. The Project proposes the replacement of an undersized bridge for Glen Helen Parkway over Cajon Wash and removal of the existing at-grade crossing within the wash.
The amended Agreement includes refinements to the Project’s On-site Temporary Restoration acreage (Measure 3.1), as the amended Project activities includes an additional 0.80 acres of temporary impacts within CDFW streambed resources.

Reasons for Exemption
On March 15, 2010, the San Bernardino County Department of Public Works, the
Lead Agency, determined that the Project is statutorily exempt pursuant to Public Resources Code section § 21080(b)(13); CEQA Guidelines, §§ 15282, subd. (g). The Lead Agency determined that the Project meets certain qualifying criteria for the exemption. Pursuant to Public Resources Code section 21080.1(a), the Lead Agency is responsible for determining whether the Project is exempt from CEQA and that determination shall be final and conclusive on all persons, including Responsible
Agencies. As a result, CDFW, acting as a Responsible Agency, is bound by the Lead Agency’s determination that the Project is exempt from CEQA.
