Document Description
The California Department of Fish and Wildlife (CDFW) has executed Streambed Alteration Agreement EPIMS Notification Number SUT-64033-R2, pursuant to Section 1602 of the Fish and Game Code to the project Applicant, Sutter County Developmental Services.
The Oswald Road Widening and Drainage Improvement Project (Project) will involve roadway reconstruction and drainage improvements along Oswald Road in unincorporated Sutter County, approximately two miles south of Yuba City. Oswald Road in the Project area is a two-lane roadway that extends in an east-west direction. The following features are anticipated for the Project:
• Installation of new drainage facilities and water quality treatment as necessary to ensure proper drainage and treatment, including a 36-inch underground storm drain within Oswald Road between State Route 99 and Gilsizer Slough.
• Installation of a new storm water outfall to Gilsizer Slough with riprap.

Reasons for Exemption
Section 15282(k) because the Project involves the installation of new pipeline or reconstruction that doesn’t exceed one mile in length. The Project falls under Class 1 because it involves repairing and upgrading of existing facilities of both investor and publicly owned utilities used for sewerage, or other public utility services. The Project also includes the enhancement of existing highways, streets, sidewalks, gutters, bicycle and pedestrian trails, and similar facilities, with no additional traffic capacity. The Project falls under Class 2 because will reconstruct utility systems and involve negligible expansion of their capacity. The Project falls under Class 3 because includes sewage extensions and other utility extensions including street improvements of reasonable length to serve such construction.
On April 16th, 2025, Sutter County Developmental Services, the Lead Agency, determined that the Project is statutorily and categorically exempt pursuant to California Code of Regulations, Title 14, section 15282(k) (statutorily) and California Code of Regulations, title 14, sections 15301, 15302, and 15303 (categorically). The Lead Agency determined that the Project meets certain qualifying criteria for the exemption. Pursuant to Public Resources Code section 21080.1(a), the Lead Agency is responsible for determining whether the Project is exempt from CEQA and that determination shall be final and conclusive on all persons, including Responsible Agencies. As a result, CDFW, acting as a Responsible Agency, is bound by the Lead Agency’s determination that the Project is exempt from CEQA.
