Reasons for Exemption
The proposed project is exempt under State CEQA Guidelines Section 15301 – Existing Facilities, which is a Class 1 exemption. Class 1 exemptions, “consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use”. Additionally, the proposed project is exempt under State CEQA Guidelines Section 15302 - Replacement or Reconstruction, which is a Class 2 exemption. Class 2 exemptions, “consists of replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced”. Furthermore, within State CEQA Guidelines Section 15302, CEQA Guidelines Section 15302(b) would apply, for the “replacement of a commercial structure with a new structure of substantially the same size, purpose and capacity”. The proposed project consists of a request for approval of a Substantial Conformance Permit for the removal and replacement of existing playground equipment, safety surfacing, drainage improvements and other associated improvements for the existing community park.
