ITS will be placing up to four (4) HMLP’s on the eastern side of the Pier G Marine Terminal South Rail Yard and then replacing two (2) of the existing 80-feet tall light poles with 2 new 120-feet tall HMLP’s.

The Class 1 Categorical Exemption consists of the operation, repair, maintenance,
permitting, leasing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or
topographical features, involving negligible or no expansion of existing or former use. The project involves minor alterations
to an existing facility at the Pier G Marine Terminal South Rail Yard for the installation of new High Mast Light Poles (HMLP)
and replacement of existing HMLP which will involve negligible alteration and no expansion of existing or former use of
the site.

Reasons for Exemption
The Class 2 Categorical Exemption consists of replacement or
reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure
replaced and will have substantially the same purpose and capacity as the structure replaced. The replacement
of two (2) new 120-feet tall HMLP’s will be located on the same site as the structure replaced and will have substantially
the same purpose and capacity as the structure replaced. All equipment that is removed from the site will be disposed of
in a manner that meets all federal, state and local environmental and regulatory requirements.

Reasons for Exemption
The Class 3 Categorical Exemption consists of
construction and location of limited numbers of new, small facilities or structures; installation of small new equipment and

modifications are made in the exterior of the structure. The project involves new installation of up to six (6) 120-feet tall HMLP with 12 LED lights in the Pier G Marine Terminal South Rail Yard Area.
