Document Description
The California Department of Fish and Wildlife (CDFW) has executed Lake and Streambed Alteration Agreement EPIMS Notification No. EPIMS SCL-53052-R3, pursuant to Section 1602 of the Fish and Game Code to City of San José. The Project is limited to any routine maintenance activity including, but not limited to, activities which are considered “routine”: • Concrete barrier repair • Concrete spall patch and/or repair • Curb repair • Deck methacrylate or polyester overlay • Deck rehabilitation • Joint replacement and/or seal • Metal beam guardrail replacement • Pressure grout • Railing repair and/or replacement • Scour repair • Sidewalk replacement and/or repair • Sinkhole repair • Slip line culvert • Substructure preservation • Tree trimming or removal • Wingwall repair

The 2026-2028 Bridge Deck Treatment Project (Project) is located at various locations within two San Francisco Bay Watersheds including the Guadalupe Watershed and the Coyote Watershed. The Project consists of 11 bridge locations throughout the City of San José.

Reasons for Exemption
On April 21, 2025, the City of San Jose, the Lead Agency, determined that the Project is categorically exempt pursuant to California Code of Regulations, Title 14, section 15301. The Lead Agency determined that the Project meets certain qualifying criteria for the exemption. Pursuant to Public Resources Code section 21080.1(a), the Lead Agency is responsible for determining whether the Project is exempt from CEQA and that determination shall be final and conclusive on all persons, including Responsible Agencies. As a result, CDFW, acting as a Responsible Agency, is bound by the Lead Agency’s determination that the Project is exempt from CEQA.
