This action is to authorize an agreement for long-term exchange of surplus water supplies to enhance reliability and meet water demands. The purpose of the agreement is to set the terms and conditions for water delivery and/or exchanges between the Water Authority and WMWD. Deliveries and exchanges will be conducted through existing facilities and within all current operational protocols.

The action is an agreement to authorize long-term exchange of surplus water supplies which will not result in a change or expansion of current use and would not result in any potential for a direct physical change in the environment. This Agreement is not a “Project” under the California Environmental Quality Act (CEQA) (Cal. Code Regs. Tit. 14, § 15378). If the agreement were considered a “Project” it would be Categorical exempt from CEQA pursuant to Section 15301, Existing Facilities and the Water Authority's Administrative Code implementing CEQA [§8.00.070(a)1(i)]. Additionally, this agreement is exempt from environmental review pursuant to CEQA Guidelines Section 15061 (b)(3), the "common sense exemption,".
