Reasons for Exemption
The Local Agency Formation Commission has determined that this proposal is exempt from the California Environmental Quality Act (CEQA) under two CEQA Sections. First, LAFCO 3275 is exempt (under the "Common Sense Rule") from environmental review since it does not have the potential for causing physical changes in the environment, directly or ultimately (Sections 15061[b][3] of the State CEQA Guidelines). This recommendation is based on the finding that approval of LAFCO 3275 does not appear to have any potential to significantly alter the existing physical environment. Secondly, approval of LAFCO 3275 is mandated by Government Code Section 56375 since the Commission has made those findings contained in Government Code Section 56375(a)(4) related to the annexation of surrounded island territory. Since the Commission has no discretion in this matter, approval of this proposal is a ministerial action that is statutorily exempt from environmental review under the provisions of Section 15268 of the State CEQA Guidelines, and the Commission's adopted CEQA Guidelines. Therefore, the proposal is exempt from the requirements of CEQA.
