Reasons for Exemption
The transfer and detachment of the District from the County to the City is exempt CEQA (Public Resources Code Section 21000 et seq.), pursuant to Sections 15061(b)(3), and 15301(b) and (c) of the CEQA Guidelines. Section 15061(b)(3) of the CEQA Guidelines exempts projects covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. The transfer and detachment of the District does not involve any land use entitlements that will allow for development on the property. The transfer and detachment would not create any public health or safety hazards and would not have a significant impact on the resources or services within the surrounding area, such as water, sanitary services, surrounding roadways and intersections. Any future projects within the District will be subject to additional environmental review and independent analysis as required by CEQA. Further, under Sections 15301(b) and (c), the transfer and detachment of the District involves the operation and maintenance of the existing publicly owned utilities and existing public infrastructure, and there is no expansion of the District.
