Document Description

Reasons for Exemption
This project involves one single-family home with associated landscape improvements. The Categorical Exemption allows one single-family residence or a second dwelling unit in a residential zone or up to three single family homes in urbanized areas. In accordance with the Callfornia Environmental Quality Act (CEQA), the recommended action is exempt from further review per State CEQA Guldelines Section 15303, Class 3(a), New Construction. Class 3(a) allows for one single-family residence, or a second dwelling unit in a residential zone. In urbanized areas, up to three single-family residences may be constructed or converted under this exemption. As aforementioned, the project involves a one single-family home with associated landscape improvements and no evidence has been presented to demonstrate that there |s a reasonable possibility that the proposed project will have a significant effect on the environment due to unúsual circumstances, and therefore is exempt from CEQA. Further, none of the exceptions outlined in State CEQA Guldelines Section 15300.2 apply. The project site contains environmentally sensitive areas including selsmic hazard landslide area, fault, two mapped drainage courses, high value habitat, and fuel modification, and very high fire hazard severity zone. Based on the requirements for geotechnical investigation prior to issuance of permits, a condition of approval requiring the applicant to submit an offer of a permanent open space easement over that portion of the property not used for physical development or service, and compliance with the fuel modification plan and request for Alternate Materials and Methods (AM&M) Request/Preliminary Fire Protection Plan, the project will not present significant Impacts to a particularly sensitive environment. There will be no cumulative Impact resulting from successive projects of the same type in the same place, over time in that no new uses are proposed. There are no unusual circumstances resulting in a significant impact on the environment. There will be no damage to scenic resources, Including trees, historic buildings, rock outcroppings or similar resources, within a highway officially designated as a state scenic highway in that none of these resources exist on the site. The project is not located on a hazardous waste site or any other site included on a list compiled pursuant to Government Code section 65962.5. The project will not result in significant adverse impacts to historical resources as defined by CEQA in that there are no historical resources on the site. Consequently, additional environmental analysis is not necessary to meet the requirements of the CEQA. Thus, the Class 3 categorical exemption applies.
