Document Description
The applicant requests approval of an application for a major use permit modification, design review permit and a coastal development permit to authorize façade modifications and interior and exterior improvements to an existing commercial restaurant tenant space, previously occupied by Islands Restaurant. The new restaurant, Encinitas Brewing Company, will include the on-site consumption of beer, wine and distilled spirits, with ancillary uses for on-sale and off-sale alcohol licenses for an on-site brewery for a new small beer and distilled spirits manufacturer, with tasting room associated with an Alcohol Beverage Control ABC Type 23 and ABC Type 74 licenses along with the expansion of outdoor patios. A parking study was completed to ensure that with the expansion of a new patio the expanded use combined with other existing uses in the center will have adequate parking within the commercial parking center.

Reasons for Exemption
The project has been determined to be exempt from environmental review pursuant to California Environmental Quality Act (CEQA) Guidelines Section 15301 (e) (Class 1-Existing Facilities), which exempts projects involving licensing (in this case for a Type 23 and Type 74 ABC licenses) of an existing land use and involving negligible or no expansion of an existing or former use. For additions to existing structures (such as the proposed outdoor patio addition) they are exempt from CEQA provided that the addition will not result in an increase of more than 10,000 square feet, the project is in an area where all public services and facilities are available to allow for the maximum development permissible in the General Plan, and the area in which the project is located is not environmentally sensitive. The project, as conditioned, qualifies for this exemption. The outdoor patio addition is less than 10,000 square feet and the project is located within an area where all public services and facilities are available, it is consistent with the General Plan, and the project site is developed and is not environmentally sensitive. None of the exceptions described under Section 15300.2 of the CEQA Guidelines applies and no historic resources are affected by the proposed project.
