Document Description
The Department of Cannabis Control, pursuant to authority granted under Business and Profession Code, Division 10, Chapter 2, Section 26012, approved a Small Outdoor commercial cannabis license. The project is located at 19163 Oak Tree Road in Nevada City, on a rural, 29.62-acre parcel (APN 060- 390-006-000) in an agricultural zoning district. This project includes 10,000 square feet of mixed light cultivation within five (5) existing 3,000 square-foot hoop houses. The project will include 9,000 square feet of support area including two (2) 2,400 square-foot green houses for immature plants and 1,850 square feet of immature plant area, 1,850 square feet of processing area and 500 square feet of office and chemical storage area located within a proposed 5,000 square foot processing building. Water for the project is provided by an onsite groundwater well. The project complies with the Nevada County Commercial Cannabis Cultivation Ordinance (NCCO) and any environmental impacts of the project are within the scope of the Program Environmental Impact Report (EIR18-0001, SCH#2018082023) that was certified on May 14, 2019, by the Nevada County Board of Supervisors and the Addendum to the Environmental Impact Report that was adopted by the Nevada County Board of Supervisors on January 10, 2023.

Reasons for Exemption
The Department of Cannabis Control has determined that the project is consistent with the local jurisdiction community plan and/or zoning designations. On May 14, 2019, Nevada County Resolution No. 19-199 certified a Program Environmental Impact Report (PEIR; SCH #2018082023) for the Nevada County Commercial Cannabis Cultivation Ordinance. On January 10, 2023, the Nevada County Board of Supervisors adopted an Addendum to the certified PEIR which analyzed potential impacts associated with amendments to the Nevada County Commercial Cannabis Cultivation Ordinance. CEQA mandates that the project is consistent with the development density established by existing zoning, community plan, or general plan policies for which an EIR was certified and shall not require additional environmental review, except as might be necessary to examine whether there are project-specific significant effects which are peculiar to the project or its site. The project activity fits within the parameters included in CEQA Guidelines Section 15183 and the activity does not require additional CEQA analysis.
