Notice of Exemption
Exempt Status
Categorical Exemption
Type, Section or Code
15301(c) - Class 1 Existing Facilities; 15302(b) - Class 2 Replacement or Reconstruction; and 15303(e) New Construction
Reasons for Exemption
The project qualifies for a Class 1 (Existing Facilities) categorical exemption because the project consists of minor alterations to existing parkland to improve pedestrian accessibility and public safety and modernize the park and does not involve significant expansion of use. The project qualifies for a Class 2 (Replacement or Reconstruction Exemption) categorical exemption because existing park structures and facilities will be replaced or reconstructed with new structures and facilities with substantially the same purpose and capacity as what is replaced, such as walkways, tennis and basketball courts, skatepark, and playground equipment. The project qualifies for a Class 3 (New Construction or Conversion of Small Structures) categorical exemption because improvements include addition of new structures such as a storage building and new fencing. Therefore, the City of Cudahy determined the Project will not have a significant effect on the environment.
