The proposed project is exempt from the California Environmental Quality Act (CEQA) pursuant to, without limitation, CEQA Guidelines Section 15332, In-Fill Development Projects, as the project is located on a lot less than five acres in size which is surrounded by urban development, the project site has no value as habitat for endangered, rare, or threatened species, approval of the project would not result in any significant effects related to traffic, noise, air quality, or water quality, and the site is adequately served by all required utilities and public services. A Vehicle Miles Traveled (VMT) Assessment concluded the project would result in a decrease of regional VMT and therefore posed no significant impact; the project also conforms with City’s Climate Action Plan, as the building is designed to be all-electric.

Reasons for Exemption
The project is exempt from CEQA pursuant to CEQA Guidelines Section 15183 in that it would be consistent with the Fremont General Plan and applicable zoning standards, as discussed in this report. The project is also exempt from further review with reference to the General Plan EIR, per CEQA Guidelines Sections 15162 and 15163, as none of the circumstances requiring preparation of a subsequent or supplemental EIR have occurred. Each of the foregoing provides a separate and independent basis for CEQA compliance.
