Document Description
The Department of Cannabis Control, pursuant to authority granted under Business and Procession Code Division 10, Chapter 2, Section 26012, approved a Cannabis Transport-Only License submitted on 6/24/2025, by Hunny Pot Farms Inc. The project proposes to establish a cannabis cultivation facility and transport-only distribution on an approximate 4.9-acre site at 2949 Niagara Avenue Colusa, CA 95932 (APN 017-130-028-000). The property is zoned Light Industrial (M-1) District and surrounded by existing industrial land uses to the north, west and south. Project construction includes up to eight 10,800-square-foot metal industrial buildings totaling 86,400 square feet and one - 6,000-square-foot metal building. Actual construction of the project would occur in phases, with the first phase involving cultivation and transport-only distribution in Building #1 and #2 totaling 21,600 square feet located at the southeast corner of the site; and dry storage in Building #9 totaling 6,000 square feet located at the northeast corner of the site. The use of the buildings would involve the cultivation (planting and growing) of cannabis plants and the harvesting, drying, trimming, and storage of cannabis flowers. Water is provided by a groundwater well and power is provided by PG & E.

Reasons for Exemption
The Department of Cannabis Control has determined that the project is a Class 32 Categorical Exemption Project. Class 32 Categorical Exemptions consist of being consistent with the City’s General Plan and Zoning Code, located withing the city limits, project is no more than five acres, substantially surrounded by urban uses, no value as habitat for endangered, rare, or threatened species, no result in any significant effects relating to traffic, noise, air quality, or water quality, and is adequately served by all public utilities. None of the exceptions to the exemption defined in Section 15300.2 apply to the Project.
