Reasons for Exemption
The State CEQA Guidelines provide a series of Categorical Exemptions for actions that have been deemed by the State Legislature to be exempt from the California Environmental Quality Act (CEQA). The proposed reconstruction of an approximate 0.69-acre area of aircraft ramp pavement within disturbed public rights-of-way has been determined to qualify for a Categorical Exemption under Paragraph 15302(c) of the State CEQA Guidelines, Section 15302(c). Categorical Exemption 15302 (c) exempts "replacement or reconstruction of existing structures or facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced , including but not limited to:" "(c) Replacement or reconstruction of existing utility systems and/or facilities involving negligible or no expansion of capacity." This proposed project has been determined to fall under the jurisdiction of CEQA and the State CEQA Guidelines because the reconstruction activities fall within the scope of the qualifying criteria listed in Section 15302(c). Therefore, this action qualifies with the requirements for a Categorical Exemption in compliance with Section of the CQA Statute 15302(c) and will not cause in significant adverse impacts on the environment.
