Reasons for Exemption
This project involves the purchase of off-grid Electric Vehicle Charging Stations that do not require construction, conduits, or trenching. The purpose of this project is to provide Electric Vehicle charging stations for Stanislaus County Public Works' Motor Pool. The project is needed to support the County's fleet transition to zero-emission vehicles; therefore, reducing tailpipe emissions and improving air quality. This installation constitutes minor alterations to existing facilities, with no expansion beyond their current use, and will not have a significant impact on the environment. The charger's max height is 15.3' and the base footprint is 18'L x 7.5' W. Public Resources Code Revised 2011 Notice of Exemption Cal. Code Regs., tit. 14, sec. 15301 provides that projects which consist of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, and which involve negligible or no expansion of use beyond that existing at the time of the lead agency's determination are categorically exempt from the provisions of the California Environmental Quality Act. The electric vehicle chargers will be placed on existing paved parking lots and will involve negligible or no expansion of use. Therefore, the project falls within section 15301 and will not have a significant effect on the environment. Cal. Code Regs., tit. 14 sec. 15303 provides that projects which consist of construction and location of limited numbers of new, small facilities or structures are categorically exempt from the provisions of CEQA.
